Why a Power of Attorney Should be Durable

A power of attorney is a legal document containing an authorization for one to act as your agent for medical and/or property decisions. These documents can be drafted to become effective immediately when you sign the power of attorney. In the alternative, these documents can be drafted so they become effective only if you are incapacitated. Powers of attorney that are tied to when you become incapacitated are referred to as durable powers of attorney in most states. California Estate Planning Attorney Jennifer Sawday recently posted an interesting article on her blog explaining why you should think twice before creating a power of attorney that is effective immediately.
