» Insurance Law:
Insurance law is the branch of law related to policies and companies who provide coverage by contract for an agreed payment in the event of loss by a specified contingency or peril. Contingencies or perils include death, health, disability, property damage, and environmental contamination.

Insurance law has its roots in contract law. Indeed, much of insurance law involves interpreting contractual language the insurance policies. Insurance controversies often relate to coverage and non-payment of claims. In addition to breach of contract claims, non-payment can result in tort damages. Insurance companies often have a duty to defend the insured and a duty to settle reasonable insurance claims.

Insurance companies, agents, and brokers are heavily regulated. There are a number of state and federal laws and agencies that regulate insurance. Statutes include the ADA, ERISA, COBRA, HIPAA, Mental Health Parity Act, and even the Tax Code.
